* What types of debt collection practices are prohibited? *

Harassment

" Debt collectors may not harass, oppress, or abuse anyone they contact. "

Debt collectors may not:

- use threats of violence
- publish a list of consumers who refuse to pay their debts
- yell, or use obscene/inappropriate language
- use the telephone to purposely annoy someone on a repeated basis

False statements

" Debt collectors may not use any false statements when collecting a debt. "

Debt collectors may not:

- state you will be arrested if you do not pay your debt
- state they will seize, garnish, or sell your property or wages
- state that actions (ex. lawsuit) will be taken against you, if they do not intend to take them

- falsely imply that they are government representatives or an attorney
- falsely imply that they operate or work for a credit bureau
- falsely imply that you have committed a crime

- claim that papers sent to you are legal forms, when they are not
- claim that papers sent to you are not legal forms, when they are
- lie about the amount of your debt

- give false credit information about you to anyone
- send you something appearing to be an official document from a government agency when it is not
- use a false name or company

Unfair practices

" Debt collectors may not engage in unfair practices when they try to collect a debt. "

Debt collectors may not:

- collect a sum greater than your debt
- contact you by postcard
- use deceptive practices to make you accept collect calls
- use deceptive practices to make you pay for telegrams
- deposit a post-dated check prematurely
- threaten to take your property
