Debt Recovery Process
Greenwood International, one of the industry leaders of the Debt Recovery Process, is happy to explain the process to all future clients.
Here are the steps:
STEP 1. Warning Letter
- Greenwood International will send one initial debt recovery letter to the debtor before issuing proceedings. This gives the debtor 7 days in which to pay.
- 75-80% of debtors will pay the amount claimed within 7 days of receiving one of our letters.STEP 2. Start Court Proceedings
- Greenwood International will issue a Claim Form. This will be sent, by the Court, to the debtor who will then have 14 days in which to respond.
- Greenwood International's extensive experience is that most debtors will pay the outstanding invoice amount within 21 days of the starting proceedings. If that happens to be the case, there will be no need to take the matter any further.STEP 3. Obtain a County Court Judgment
- If the debtor still has not paid after the start of court proceedings, Greenwood International will apply for a County Court Judgment (CCJ) on the behalf of our client. A CCJ is a judgment ordering the debtor to pay the amount you are claiming, as well as interest and court fees on top of it.
- A CCJ can be enforced at any time, up to 6 years after it is granted. Greenwood International will enforce it as soon as we are instructed to do so, by our client.STEP 4. Enforcing the Judgment
- As soon as judgment is granted, Greenwood International can now start to take enforcement proceedings against the debtor. A bailiff will go to the debtor's premises, in an attempt to seize and sell goods to the value of the amount that has been awarded by the court.
- Usually, at this stage of the process, the debtor will pay the amount claimed in order to avoid the the disruption to business, and embarrassment, of having their goods seized.STEP 5. Other methods of enforcement
